Terms and Conditions

Article 1 - Scope

The present conditions exclusively govern the sales of products and services offered by Le Rouge & Le Blanc published by the SARL Les Editions du Vin with capital of € 1,677.50, whose registered office is located at 36 rue Gassendi, 75014-PARIS, registered in the register Paris Trade and Companies under number 327 511 580.

The fact of buying on line or by correspondence products and / or services, in accordance with the conditions defined hereafter, implies the whole and unreserved adhesion of the purchaser to these general conditions of sale of the magazine Le Rouge & Le White, which represent the entire agreement between the customer and Le Rouge & Le Blanc.

In case of non-compliance with the terms of these general conditions, Le Rouge & Le Blanc reserves the right to take any measure likely to preserve its interests and in particular to ensure the execution. The Rouge & Le Blanc can then assign the client civil and / or criminal liability.

In the case of a subscription, Le Rouge & Le Blanc reserves the right to terminate immediately, without any formality and as of right, the subscription in case of violation of one of the clauses set out below.

Any contrary condition not accepted by Le Rouge & Le Blanc is unenforceable. The fact that Le Rouge & Le Blanc does not take advantage of one of the present general conditions of sale does not amount to a renunciation of the Rouge & Le Blanc to take advantage later.
 

Article 2 - Access to the site

The customer is personally responsible for setting up computer and telecommunication facilities to access the Rouge & Le Blanc site.

The customer retains the cost of telecommunications when accessing the Internet and use of the Site and services to which the customer has subscribed.

Article 3 - Information on products and services

In accordance with Article L. 111-1 of the Consumer Code, Le Rouge & Le Blanc invites internet users to browse its website in order to discover the products and services offered for sale by Le Rouge & Le Blanc and to enable them to know before the order the essential characteristics of the said products and services.

Article 4 - Price

Prices are quoted in euros, all taxes included, excluding the cost of processing and shipping. Le Rouge & Le Blanc reserves the right to change the price of products and / or services at any time but agrees to apply the rates in effect at the time of registration of the order.

All product orders are payable in euros.

The customer agrees to pay the full price and charges for the service purchased, including taxes at the time of validation of his order. The customer is solely responsible for the actual payment of the subscribed service.

Article 5 - Terms of payment

In accordance with the legal provisions relating to the application of the European Single Bank Payments Area (SEPA), one or both of the following four payment methods may be offered depending on the offer concerned:

    payment by credit card by secure payment server (Blue Cards of GIE bank, credit card, Visa, MasterCard).
    PAYPAL payment
    payment by bank transfer for the benefit of Editions du Vin SARL, at the Paris Montparnasse Crédit du Nord - IBAN: FR76 3007 6020 4326 8528 0020 030 and BIC: NORDFRPP
    payment by check payable to Editions du Vin SARL, to: Le Rouge & Le Blanc Subscription - 43 rue de la ferme Bat D App 422 92200 NEUILLY SUR SEINE

Regarding online payment by credit card: payment is provided by the secure solution Stripe, which incorporates an encryption process via the Transport Layer Security (TLS) protocol. Thus the details of your credit card never transit unencrypted on the network.

Regardless of the type of offer subscribed, only the user is responsible for payment by credit card of the proposed service. Le Rouge & Le Blanc is not responsible for payment problems related to the malfunction of the e-commerce service.

Article 6 - Validation of the order

Before confirming the order, the customer can at any time correct any errors made in the entry of his data.

VALIDATION BY THE CLIENT OF HIS ORDER IS ACCEPTANCE OF THESE TERMS AND CONDITIONS, FULLY AND WITHOUT RESERVE. TO CONFIRM YOUR ORDER, THE CUSTOMER MUST CLICK ON THE "CONFIRM MY ORDER" BUTTON AT THE END OF THE ORDER. AN ACCUSED OF RECEIPT WILL BE ADDRESSED BY RETURN TO THE EMAIL ADDRESS IN THE ORDER FORM, INDICATING THE EXACT AMOUNT INVOICED AND THE TERMS OF DELIVERY OF THE ORDER.

This acknowledgment is acceptance of the order and validates the transaction.

 

The customer acknowledges that the data recorded on the Site constitute the proof of the transaction (type of offer subscribed and date) and the data recorded by the payment system described above, the proof of the financial transaction.

Le Rouge & Le Blanc reserves the right to suspend and / or refuse any customer order with which Le Rouge & Le Blanc is in dispute, for whatever reason, without the latter being able to claim any compensation.

The subscription is set up by Le Rouge & Le Blanc as soon as possible.

Article 7 - Duration and termination

All subscriptions are taken out for the period indicated in the chosen offer. The chosen offer also mentions the conditions of termination and the conditions of renewal.

In the event that the Customer wishes to cancel his subscription and obtain the refund, it is advisable to address a mail to the subscription service by mentioning his name, first name, address, e-mail address as well as his subscriber number.

The customer can do this by joining his last shipping label. The cancellation of the subscription will take effect upon receipt of the mail. The refund will be calculated in proportion to the numbers remaining to be used on that date. In any case provide for a period of 8 weeks, to receive the refund, due to the administrative processing of the transaction.

Article 8 - Delivery terms

a) The publications are delivered to the address indicated during the ordering process, provided that the customer informs exactly and gives all the necessary details to the good routing of his order.

Schedules and delivery times are those usually used by the postal services, Le Rouge & Le Blanc declining all liability in the event of failure and / or delay of delivery of publications caused by a total or partial malfunction of the postal service.

The customer can obtain, at his request, an invoice using the option provided on the order form.

 
The numeric publications are delivered on the account created by the customer on the website. They are read only material and cannot be printed or downloaded.

b) Unless otherwise stated in the offer, ordered products (eg old numbers) will be delivered to the address specified by the customer during the ordering process (provided that the place of delivery is located in a country of European Union), within a maximum period of 30 (thirty) days from the receipt of the payment of the order.

In case of total or partial unavailability of a product after placing the order, the customer will be informed by email. In this case, the customer will have the option to be refunded the price of the product ordered, within 30 days of his request. The delivery costs of the replacement product will be borne by Le Rouge & Le Blanc.

The Rouge & Le Blanc undertakes to make its best efforts to deliver the products ordered by the customer within the time specified above.

In case of non-compliance with the delivery deadline, for any other cause than a case of force majeure as defined by French case law, the sale can be solved at the written request of the customer or the Rouge & Le Blanc, by registered letter with acknowledgment of receipt. The sums paid by the customer will then be returned to him within a maximum period of 30 working days, excluding any other compensation.

Article 9 - Right of withdrawal / Refund

In accordance with Article L. 121-21 of the Consumer Code, the customer has a period of fourteen (14) days to request the refund of his order. This period runs from:

    the receipt of his order in the event of delivery of goods;
    The conclusion of the contract in connection with the subscription of a subscription.

The customer informs Le Rouge & Le Blanc of his decision to retract by sending him, before the expiry of the fourteen (14) day period, a request for retraction.

No penalty will be claimed; however, the return costs will be borne by the customer. In order to ensure the follow-up of his parcel, the customer will have to make his return in colissimo followed.

The customer agrees to return or return the order without undue delay and no later than fourteen (14) days after the communication of its decision to retract.

The products must be returned in their original packaging and in perfect condition, accompanied by the invoice to the following address: LE ROUGE & LE BLANC - 36 rue Gassendi, 75014-PARIS

Damaged, soiled or incomplete items will not be taken back and can not be refunded.

Refunds will be made within 14 days of receipt of the request.

However, Le Rouge & Le Blanc reserves the right to defer the reimbursement until recovery of the goods provided that they are in good condition as indicated above.

Special cases :

As part of subscribing to a subscription contract, the customer authorizes Le Rouge & Le Blanc to execute the subscription immediately without waiting a period of fourteen (14) clear days, it being specified that the customer retains the possibility of exercising his right of withdrawal.

The right of retraction does not apply to the purchase at the number of a copy in the network of the partner depots of the Rouge & Le Blanc (wine merchants, specialized bookstores, etc.)

Article 10 - Computers and Freedom

The Rouge & Le Blanc respects the privacy of its customers and strictly complies with the laws in force on the protection of privacy and individual freedoms.

The data collected by the Rouge et le Blanc concern the identity of the customer (such as his name, first name, postal address, e-mail address, telephone number), e-mails exchanged as well as data specific to purchases (orders , invoices).

Personal data are kept for a few years to allow the customer to renew his subscriptions without having to re-enter all his personal data.

In accordance with Article L123-22 of the French Commercial Code, orders and invoices have a legal retention period of 10 years from the end of the financial year.

Le Rouge & Le Blanc agrees that the personal information of the client is used only for transaction purposes and, if applicable, for prospecting purposes for products and services of the Site du Rouge & Le Blanc, subject to the agreement of the customer obtained under the conditions required by law. In addition, Le Rouge & Le Blanc certifies that its files and automated processing of personal data have been declared to the CNIL in accordance with the Data Protection Act of 6 January 1978.

In accordance with the Data Protection Act of January 6, 1978, the customer has a right of access, rectification and opposition to personal data concerning him. The customer has the opportunity to exercise this right online by going to his account on the Site or by writing to the Rouge & Le Blanc, by email or post.

The customer can also retrieve their personal information in a structured, commonly used and machine readable format. This operation can be performed from his account under "GDPR - PERSONAL DATA".

The customer acknowledges being informed that, unless otherwise advised by him, his contact details may be used for prospecting purposes for other services and / or products offered by Le Rouge & Le Blanc and be subject to automated processing .

Le Rouge & Le Blanc reserves the right to inform its customers by e-mail of the evolution of its own services or commercial offers.

Article 11 - Intellectual property

The user of the site www.lerougeetleblanc.com is prohibited from reproducing and / or using the brands and logos present on the site, as well as from modifying, copying, translating, reproducing, selling, publishing, exploiting and diffusing in a digital or other format, all or part of the information, texts, photos, images, videos and data present on the site, which constitute works within the meaning of the provisions of Article L112-1 of the Code of Intellectual Property. Violation of these mandatory provisions subjects the offender, and all persons responsible, to the criminal and civil penalties provided for by law.

Le Rouge & Le Blanc remains the exclusive owner of all the intellectual property rights attached to the name, logo and trademarks of the Site, its structure and dress, and the content of the Site (including, text, photos, illustrations, videos, hypertext links) all over the world.

Article 12 - Applicable law

These general conditions of sale are subject to French law. The language of this contract is French. In case of dispute, the French courts will be competent.

Article 13 - Autonomy of the clauses of the contract

If any of the provisions contained in the General Conditions of Sale were declared void by the competent court, the other provisions would not be affected and would retain all their force and scope.

Article 14 - Modification of the general conditions of sale

The Rouge & Le Blanc reserves the right to adapt or modify at any time these terms and conditions. The new general conditions of sale will, if necessary, be brought to the attention of the customer by online modification and will be applicable only to sales made after the modification.
